Article 1 - Orders and Customer Account
1.1 - Customer Account
To place an order, the Customer is invited to create an account or order as a guest. The Customer can modify their data at any time by logging into their account. They are responsible for updating the information provided. To access their personal space and order history, the Customer must identify themselves using their username and password, which will be provided after registration and are strictly personal. As such, the Customer is forbidden from disclosing them. Otherwise, they will be solely responsible for any use made of them. The Customer may request to unsubscribe at any time by visiting the dedicated page or by sending an email to customercare.manitowoc@synneo.fr. This will be done within a reasonable period. In case of non-compliance with the general terms and conditions of sale and/or use, SYNNEO will have the possibility to suspend or even close a customer's account after a formal notice has been sent electronically and remains without effect. Any deletion of the account, for whatever reason, results in the complete deletion of all the Customer's personal information. Any event due to a case of force majeure resulting in a malfunction of the site or server and subject to any interruption or modification for maintenance, does not engage the responsibility of the Seller.
1.2 - Payment methods
The Customer can place an order on this Site and can make their payment by:

No data related to the Customer's payment methods is collected by the Site. The payment is made directly into the hands of the bank or the payment provider receiving the Customer's payment. The order forms and invoices will be archived on a reliable and durable medium constituting a faithful copy. The computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Article 2 - Order Validation
The Customer declares to have read and accepted these General Terms and Conditions of Sale before placing their order. The validation of their order therefore constitutes acceptance of these General Terms and Conditions of Sale.
Article 3 - Availability
The availability of the Products is indicated on the Site, in the descriptive sheet of each Product. In the event of a product's unavailability after the order has been placed, the Customer will be informed. The order will be automatically cancelled and no invoicing will be carried out.
Article 4 - Delivery
4.1 - Generalities
The products are delivered to the delivery address that the Customer will indicate during the ordering process, except for delivery restrictions indicated on the order validation page by the customer. The Site offers deliveries only to the countries present on the site, orders can be shipped anywhere in the world, if the country is referenced. In case of delivery of a Product outside the territory of the European Union and in the DROM-COM, the Customer declares to be the importer of the Product and accepts that in such a case, the Seller may be materially unable to provide them with accurate information on the total amount of fees related to customs duties and formalities or import taxes applicable in the country where the delivery of the Product is requested. Unless otherwise indicated on the Site during the ordering process or in the description of the ordered Products, the Seller undertakes in all cases to deliver the Products within a maximum of thirty (30) days after the conclusion of the contract with a Consumer Customer, on the condition that the ordered products are available.
4.2 - Delivery times
The delivery time corresponds to the shipping and preparation time indicated in the "delivery" step of the sales funnel, and according to the choice made by the customer. Shipments are scheduled for D+1. In case of delivery by a carrier requiring an appointment with the Customer, the latter will contact the Customer as soon as possible to arrange a delivery appointment, no later than 30 days from the date of your order validation. SYNNEO cannot be held responsible for delivery delays due exclusively to the unavailability of the customer after several appointment proposals by the carrier.
Article 5 - Errors and delivery delays
In case of a delivery error or exchange, any product to be exchanged or refunded must be returned to the Seller in its entirety and in perfect condition. Any defect resulting from clumsiness or a false maneuver by the Customer cannot be attributed to the Seller. In case of shipping delay, an email will be sent to the Customer to inform them of any possible consequence on the indicated delivery time. In case of delivery delay, a new delivery time will be proposed. Any delivery delay compared to the date or time indicated to the Consumer Customer during their order or, in the absence of an indicated date or time during the order, exceeding thirty (30) days from the conclusion of the contract may lead to the resolution of the sale at the initiative of the Consumer Customer under the conditions provided for in articles L 216-2, L 216-3 and L241-1 of the Consumer Code. The request must be made in writing by the customer, sent by registered letter with acknowledgment of receipt if, after having ordered the Seller to make the delivery, it has not done so. A credit note will be sent to the Consumer Customer, no later than thirty (30) days following the date on which the contract was terminated, for the full amount of the goods concerned. This clause is not intended to apply if the delivery delay is due to a case of force majeure.
Article 6 - Receipt
In case of reservations about the delivered product (for example: damaged package, already opened...), the Customer must immediately notify the carrier and SYNNEO. The Customer may refuse a package at the time of delivery if they notice an anomaly concerning the delivery (damage, missing Product compared to the delivery note, damaged package, broken Products...); any anomaly must then be indicated by the Customer on the carrier's slip, in the form of handwritten reservations, accompanied by the Customer's signature. To exercise their right of refusal, the Customer must open the damaged or defective package(s) in the presence of the carrier and have the damaged goods returned. Failing to comply with these requirements, the Customer will not be able to exercise their right of refusal, and the Seller will not be required to comply with the Customer's request to exercise the right of refusal.
Article 7 - Transfer of ownership – Transfer of risks

Article 8 - Warranties
8.1 - Product conformity
In accordance with the provisions of the legal guarantees of conformity and hidden defects (referred to in the box below and whose texts are specified in Annex 1 of these conditions), SYNNEO will exchange products that are apparently defective or do not correspond to the Customer's order. The Customer must then contact the Seller within a period of 7 (seven) days. The products must be returned in the state in which the Customer received them with all the elements (accessories, instructions...) in packaging allowing for good transport conditions. The shipping costs will be reimbursed based on the invoiced rate and the return costs will be reimbursed upon presentation of supporting documents.
Article 9 - Liability
The Seller's liability can only be engaged in case of gross, intentional or fraudulent fault. In all other cases, the Seller's liability can never be sought or engaged by the Customers. The products offered are in compliance with the French legislation in force. SYNNEO's liability cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is the Customer's responsibility to check with local authorities the possibilities of importing or using the products or services they plan to order.
Article 10 - Intellectual property
All texts, comments, works, illustrations, works and images reproduced or represented on the SYNNEO Site are strictly reserved under copyright as well as intellectual property rights and for the entire world. As such and in accordance with the provisions of the intellectual property code, only use for private use, subject to different or more restrictive provisions of the intellectual property code, is authorized. Any total or partial reproduction or representation of the Site or of all or part of the elements on the Site is strictly prohibited. The corporate names, brands and distinctive signs reproduced on the Site are protected under trademark law. The reproduction or representation of all or part of one of the aforementioned signs is strictly prohibited and must be subject to prior written authorization from the trademark owner.
Article 13 - Applicable Law – Disputes – Handling of complaints
Applicable law: This contract is subject to French law. The language of this contract is the French language. In case of dispute, only the French courts will be competent. The translation of these general terms and conditions of sale has no contractual value and is only for the purpose of informing the customer.
Handling of complaints: For any complaint, you can contact the customer service department at the contact details mentioned in the preamble of these conditions, or via the contact page of the site.
Jurisdiction: In case of difficulty arising during the ordering or delivery of the items sold on the Site, the Customer will first contact SYNNEO to seek an amicable solution. Any dispute resulting from the formation, interpretation or execution of this contract will be the exclusive competence of the courts of NICE, notwithstanding a plurality of defendants or a call for a guarantee.
