Preamble
The present general terms and conditions of sale (hereinafter "GTC") apply to all sales of products made on the website https://manitowoc-shop.eu/, owned by the company Synneo which operates on behalf of Synneo.
The customer declares to have read and accepted these GTC by ticking the box provided for this purpose before starting the online ordering procedure.
Article 1: Purpose
These GTC govern the contractual relationship between the company Synneo and any non-commercial individual (the "Customer") making a purchase on the site. They aim to define the conditions of sale, from placing the order to after-sales services, including payment and delivery.
Article 2: Products
The products governed by these GTC are those listed on the Seller's website. They are offered subject to stock availability.
Each product is presented with a descriptive sheet containing its essential characteristics. The photographs are intended to be as faithful as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colors.
Article 3: Prices
The prices of the products are indicated in euros (€) or Pounds Sterling (GBP), all taxes included (TTC), taking into account the VAT applicable according to the country, on the day of the order. Any change in the VAT rate may be reflected in the price of the products.
The prices indicated do not include processing and delivery fees, which are billed in addition and indicated before the final validation of the order.
The Seller reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of the order's validation.
Article 4: Order
To place an order, the Customer must follow these steps:
- Select the products and add them to the cart.
- Validate the content of the cart.
- Log in or create a customer account.
- Choose the delivery method.
- Choose the payment method and accept these GTC.
- Validate the payment.
The confirmation of the order implies acceptance of these GTC, the recognition of having perfect knowledge of them and the waiver of the right to invoke its own purchase conditions. A confirmation email summarizing the order (products, price, quantity...) will be sent to the Customer by the Seller.
Article 5: Payment methods
Payment is due immediately upon order. The Customer can pay by:
- Credit card (Visa, MasterCard): Payment is secured by the 3-D Secure system.
- PayPal: By choosing this payment method, the Customer will be redirected to the PayPal website.
The Seller reserves the right to suspend any order processing and any delivery in case of refusal of payment authorization from officially accredited bodies or in case of non-payment.
Article 6: Delivery
Delivery is made to the delivery address indicated by the Customer when placing their order.
Delivery times are given for informational purposes only; if they exceed thirty days from the order, the sales contract may be terminated and the Customer refunded.
The Customer is required to check the condition of the packaging of the goods and their contents upon delivery in the presence of the carrier's representative. In case of damage during transport, any protest must be made to the carrier within three days of delivery.
Article 7: Right of withdrawal
In accordance with article L.221-18 of the Consumer Code, the Customer has a period of fourteen (14) days from the receipt of their products to exercise their right of withdrawal without having to justify reasons or pay a penalty.
The return of the product must be in its original packaging, and in perfect condition. The return costs are borne by the Customer.
To exercise this right, the Customer must notify their decision to withdraw by means of an unambiguous statement (for example, a letter sent by post or an email).
The Seller will refund all sums paid, including delivery costs, within fourteen days following the notification of the withdrawal, using the same payment method as the one used by the Customer for the initial transaction.
Article 8: Legal guarantees
All products supplied by the Seller benefit from the legal guarantee of conformity provided for in articles L. 217-4 et seq. of the Consumer Code and the guarantee against hidden defects provided for in articles 1641 et seq. of the Civil Code.
Guarantee of conformity:
The Seller is required to deliver a good that conforms to the contract and is liable for any defects in conformity existing at the time of delivery.
Guarantee against hidden defects:
The Seller is liable for the guarantee against hidden defects of the sold item that make it unfit for the use for which it is intended.
In case of non-conformity of a sold product, it can be returned, exchanged, or refunded.
Article 9: Liability
The Seller, in the process of distance selling, is only bound by an obligation of means. Its liability cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service disruption, or other involuntary problems.
Article 10: Intellectual property
All elements of the site https://manitowoc-shop.eu/ are and remain the intellectual and exclusive property of the company Synneo. No one is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site, whether they are in the form of a photo, logo, visual, or text.
Article 11: Personal data
To benefit from the service, Synneo must process your personal data.

Article 12: Force majeure
The Seller's liability cannot be engaged if the non-execution or the delay in the execution of one of its obligations described in these GTC results from a case of force majeure.
Article 13: Applicable law and disputes
These distance selling conditions are subject to French law. For all disputes or litigation, the competent court will be that of the defendant's place of residence or, at the choice of the plaintiff, the place of effective delivery of the product.
